Terms and Conditions
1. General provisions
1.1. Online store vmist.pl, available at www.vmist.eu is operated by Marcin Sajdek Solutions with the registered office at Stalowa Wola, Wolnosci street 6 apt. 7, NIP: 1133057353, REGON: 521893026.
1.2. Contact with the Seller is possible at the following e-mail address: vmiststore@gmail.com or by phone: +48603950345.
1.3. These Terms and Conditions are addressed to both consumers and entrepreneurs using the Online Store.
2. Definitions
2.1. Client - an individual, legal entity, or organizational unit without legal personality that uses the Online Store and enters into a Sales Agreement with the Seller.
2.2 Seller – the entity specified in point 1.1 of these Terms and Conditions.
2.3 Online store - the website available at www.vmist.eu,through which the Client can place Orders.
2.4. Product – the VMIST motorcycle helmet visor cleaning system available in the Online Store, which is the subject of the Sales Agreement between the Customer and the Seller. The Store also offers dedicated brackets compatible with the VMIST system.
2.5. Sales Agreement – an agreement for the sale of a Product entered into at a distance between the Client and the Seller via the Online Store.
2.6. Order – a Client's statement of intent aimed directly at entering into a Sales Agreement, specifying the type and quantity of the Product.
3. Terms and conditions of concluding the Sales Agreement
3.1. The Customer may place Orders 24 hours a day via the website.
3.2. In order to place an Order, the Customer should:

add Product to cart,

complete the order form, providing the data necessary to complete the Order,

choose the delivery method and payment method,

confirm placement of the Order.
3.3. The conclusion of the Sales Agreement takes place upon confirmation of acceptance of the Order by the Seller.
4. Prices and payment methods
4.1. Prices given on the Store's website for a given Product are gross prices in Polish zloty and include VAT, but do not include the costs of Delivery of the Product and the selected payment method.
4.2. The customer can choose from the following payment methods:

4.3. If you wish to receive an Invoice for your purchase, contact is required before or immediately after making the purchase.
4.4. The total price of the order, visible in the Basket area before placing the order and after selecting the method of Delivery of Goods and payment, includes the price for the ordered Goods together with taxes and all related costs, in particular Delivery and transaction costs.
4.5. The payment card operator is (payment option via Przelewy24) PayPro SA Settlement Agent, ul. Kanclerska 15, 60-327 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court of Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the KRS number 0000347935, NIP 7792369887, Regon 301345068.
4.6. The customer is obliged to make payment:
– at the time of delivery of the Goods – in case of choosing the cash payment method,
– within 7 days – if you choose the traditional bank transfer payment method,
– at the time of placing the order – in case of choosing the payment method using an external payment system.
4.7. The Seller shall refund the payment immediately, no later than within 14 days from the date the cause arose, in the event of:
- withdrawal from the contract by the Consumer,
- the Customer cancels the order or part of the order paid for before its execution,
- recognition by the Seller of the claim covered by the complaint in whole or in part, on the basis of generally applicable provisions.
4.8. Refunds will be made using the same payment method that was used by the Customer in the original transaction, unless the Customer agrees to another solution that does not involve any costs for the Customer.
5. Delivery
5.1. The Seller offers delivery of the Product via courier/transport companies throughout the European Union.
5.2. In the process of placing an Order, the Customer selects the supplier and the form of delivery of the Product and accepts the delivery cost.
5.3. The delivery cost is provided each time the delivery method is selected, and the total cost of the Order (the price of the Product and the delivery cost) is clearly presented in the Order summary before it is placed by the Customer.
5.4. The Seller acts in the delivery process solely as an intermediary between the Customer and the courier/transport company. The amount paid by the Customer as delivery costs constitutes the courier/transport company's remuneration for the performance of the transport service and is transferred in full by the Seller to that company.
5.5. The Seller re-invoices the transport service provided by the courier/transport company to the Customer based on documents received from these companies.
5.6. The delivery time is 1-5 business days from the moment of receipt of payment.
6. Right of withdrawal
6.1. The provisions contained in this article concerning the right of withdrawal from the contract by Consumers shall apply to a natural person concluding a contract directly related to their business activity, when it results from the content of this contract that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by them, made available under the provisions on the Central Register and Information on Business Activity.
6.2. The Consumer has the right to withdraw from the contract concluded with the Seller via the Online Store, without giving any reason, within 14 days from the day on which the Consumer or a third party indicated by him, other than the carrier, came into possession of the Product.
6.3. In order to exercise the right to withdraw from the Agreement, the Customer may use the model withdrawal form or contact us by e-mail at vmiststore@gmail.com, sending an unequivocal statement of withdrawal from the agreement.
6.4. In the event of withdrawal from the Agreement, the Customer is obliged to return the Product to the Seller's address.
6.5. The Customer bears the direct costs of returning the Product.
6.6. The Consumer is obliged to return the Product in an undamaged condition, without traces of use beyond what is necessary to establish the nature, characteristics and functioning of the Product, immediately, but no later than 14 days from the date on which he withdrew from the contract.
6.7. The Seller will return to the Consumer all payments received, including the full cost of delivery, no later than 14 days from receipt of information about the withdrawal from the contract.
6.8. The Seller may withhold reimbursement until receiving the Product or until providing proof of its return, depending on which event occurs first.
7. Complaints
7.1. Complaints may be submitted under a warranty or guarantee, if granted.
7.2. In the event that the Product is covered by a guarantee, the Customer is entitled to make a complaint about the Product using the rights resulting from the guarantee, by filing a complaint through the Seller or directly to the guarantor. In the event that the Consumer exercises the rights under the guarantee, the time limit for exercising the rights under the warranty is suspended on the day the Seller is notified of the defect. This time limit continues to run from the day the guarantor refuses to perform the obligations resulting from the guarantee or the ineffective expiry of the time limit for their performance.
7.3. The right to exercise the rights arising from the warranty is granted independently of any rights arising from the guarantee. The exercise of any rights arising from the guarantee does not affect the Seller's liability under the warranty.
7.4. A complaint under the warranty may be filed by letter or e-mail to the postal or electronic address of the Seller. It may be filed using the form, the template of which is an appendix to the Regulations, but this is not obligatory.
7.5. In the content of the complaint submitted under the warranty, it is recommended to include:
- contact details of the Consumer, which will be used to respond to the complaint and conduct correspondence related to it,
- the Consumer's bank account number, which will be used to refund the funds in the event of such circumstances,
- in the event of such circumstances, a description of the problem and the Consumer's identification data.
7.6. If the warranty claim concerns a Product, in order for the Seller to consider the claim, the Consumer is obliged to deliver or send the Product subject to the claim to the Seller's address, at the Seller's expense. The Seller reserves the right to withhold the refund of funds incurred by the Consumer for the shipment of the goods until the claim is recognized as justified. At the customer's request, the Seller may indicate carriers enabling the shipment of the Product that is the subject of the claim.
7.7. The Seller recognizes complaints regarding:
- warranty within 14 days from the date of notification,
- possible warranty, within the period specified in the warranty conditions.
7.8. The Seller will inform the Consumer about the method of resolving the received complaint:
- under the warranty by electronic means or by regular mail, depending on the Consumer's will or the method of filing a complaint used by him,
- under any warranty in the manner specified in the warranty conditions.
7.9. If the warranty claim concerns a Product that, after the complaint has been considered, is to be sent to the Consumer, the Seller shall deliver or send the Product to the Consumer's address.
7.10. Refunds in connection with warranty claims will be made by bank transfer or postal order, in accordance with the Consumer's wishes.
7.11. The application of the warranty right is excluded in relation to Customers who are not Consumers.
8. Warranty
8.1. The product is covered by a 12-month manufacturer's and seller's warranty.
8.2. The warranty is granted at the time of purchase of the Product.
8.3. The warranty covers material and manufacturing defects revealed during the warranty period.
8.4. The warranty does not cover:
- mechanical damage resulting from improper use,
- natural wear and tear of materials resulting from normal use,
- damage resulting from improper storage or maintenance of the Product.
8.5. The Seller reserves the right to reject the claim if it is determined that the damage was caused by reasons not covered by the warranty.
8.6. The Seller reserves the right to charge a fee for shipping replaced/repaired items to the Customer.
